Terms of Service

Welcome to Lokaspace. By accessing or using our services, you confirm that you have read, understood, and agree to these Terms of Service. Please read this document carefully before using the Lokaspace platform.

The Lokaspace service is operated by Lokaspace (referred to as "Lokaspace", "we", or the "operator"), which is currently managed and operated as a sole proprietorship (individually-owned business) under the laws of the Republic of Indonesia.

1. Definitions

• ·Platform - the Lokaspace website builder service accessible via lokaspace.com, including all subdomains and features within it.
• ·User - an individual or business entity that registers for and uses the Platform.
• ·Tenant - a User who has subscribed and has an active website on the Platform.
• ·Content - all text, images, videos, data, and other materials uploaded or created by a User on the Platform.
• ·Plan - a subscription option (Free Trial, Starter, Professional) along with its applicable features and pricing.
• ·Personal Data - any data relating to an identified or identifiable individual, as defined under the Indonesian Personal Data Protection Law.

2. Registration & Account

1. 2.1To use the Platform, you must register using accurate, complete, and up-to-date information.
2. 2.2You are fully responsible for keeping your password confidential and for all activity that occurs under your account.
3. 2.3Each email address may only be used for one account. Registering multiple accounts is not permitted.
4. 2.4We reserve the right to suspend or delete accounts found to be in violation of these Terms, and will provide prior notice via email or dashboard. For serious violations - including but not limited to online gambling, illegal content, or situations that could directly harm the Platform or other Users - we reserve the right to suspend or delete the account, or take down the domain/content, immediately without prior notice.

3. Plans & Payment

1. 3.1Lokaspace offers paid subscription plans following a 7 (seven) day free trial period.
2. 3.2Payments are processed through a third-party payment provider. Lokaspace does not store your card details or payment instrument data.
3. 3.3Listed prices already include hosting, SSL, and a lokaspace.com subdomain. Third-party domain fees (if used) are borne by the User.
4. 3.4We reserve the right to change pricing with at least 14 (fourteen) calendar days' notice before the change takes effect. Price changes do not apply retroactively to an ongoing subscription period.
5. 3.5As a general rule, successfully processed payments are non-refundable, as fees cover the allocation of resources (hosting, storage, and infrastructure) provisioned from the start of the subscription period.
6. 3.6Exceptions to clause 3.5 apply where: (a) a billing error occurred that was solely caused by Lokaspace's systems; (b) the service was completely inaccessible due to a failure entirely within Lokaspace's control for more than 72 (seventy-two) consecutive hours within a single subscription period; or (c) cancellation is requested within 7 (seven) days of the initial payment and no significant use of paid features has occurred. In these cases, the User is entitled to a proportional refund.
7. 3.7A custom domain registered through the Platform is registered for a term of 1 (one) year from the date of registration, regardless of your Plan's billing cycle (monthly, 3-month, 6-month, or 12-month). Domain registration fees are billed separately from Plan fees and are not prorated or adjusted to match the Plan's active period.
8. 3.8If your Plan subscription lapses before the 1 (one) year custom domain term ends, your website will be temporarily deactivated as set out in Section 4, but your custom domain registration continues to run until its own due date and is not cancelled or refunded as a result. You may reactivate your Plan at any time to reconnect the domain to your website.
9. 3.9Renewing a custom domain after its 1 (one) year term expires requires a separate payment at the price applicable at the time of renewal. We will send a notification ahead of the domain's due date, but failure to renew before that date may result in the domain becoming inactive and potentially available for registration by other parties through the registrar, outside of Lokaspace's control.
10. 3.10Consistent with clause 3.5, custom domain registration and renewal fees are non-refundable once the registration process with the registrar has begun, as these fees are passed directly to the third-party domain registration provider.
11. 3.11After a custom domain is successfully registered, DNS propagation and SSL certificate issuance are required before the domain is fully accessible to the public. This process typically completes within minutes to a few hours, but may take longer in certain conditions depending on the registrar and the visitor's network. Propagation status can be monitored from your dashboard.

4. Active Period & Deactivation

1. 4.1A Tenant's website remains active for the duration of the selected subscription period. Once the active period ends, the website will be temporarily deactivated.
2. 4.2While a website is deactivated, the Tenant's data and content remain stored in our systems. You may reactivate your subscription at any time to restore full access to your website and data.
3. 4.3We will send a notification before the active period ends via the registered email, as part of our commitment to transparency with Users.

5. Content & Intellectual Property

1. 5.1All content you upload remains entirely your own property. Lokaspace does not claim ownership over User content.
2. 5.2By uploading content, you grant Lokaspace a limited, non-exclusive, royalty-free license to display that content on the Platform solely for the purpose of providing the service.
3. 5.3You may not upload content that infringes the copyright of others, or that contains material that is discriminatory, pornographic, violent, related to online gambling in any form, or otherwise unlawful under the laws of the Republic of Indonesia.
4. 5.4All elements of the Platform - including its design, code, templates, brand, and the Lokaspace logo - are the property of Lokaspace and are protected under applicable intellectual property law.

6. Prohibited Use

You may not use the Platform to:

• ·Engage in activity that violates applicable laws and regulations in Indonesia.
• ·Spread misleading information, engage in fraud, or send spam.
• ·Take actions that damage, disrupt, or place excessive load on the Platform's infrastructure.
• ·Reverse engineer the Platform's code or systems.
• ·Resell access to the Platform without Lokaspace's written permission.
• ·Operate, facilitate, or promote online gambling in any form, including through a domain name, content, links, or advertisements directing users to a gambling service.

7. Service Availability

1. 7.1We work to keep the Platform available at all times, but we cannot guarantee a completely uninterrupted service. Scheduled maintenance will be announced in advance via email or dashboard.
2. 7.2Lokaspace is not liable for losses arising from service disruptions caused by circumstances reasonably beyond our control (force majeure), such as natural disasters, disruptions at third-party infrastructure providers, or government policy.
3. 7.3Clause 7.2 does not remove your right to compensation under clause 3.6 where a disruption is caused by circumstances within Lokaspace's control.

8. Changes to the Service & These Terms

Lokaspace reserves the right to change its features, pricing, or these Terms of Service at any time to support the ongoing development of the service. Material changes will be communicated via your registered email or a dashboard notification at least 14 days before taking effect. If you do not agree with a change, you may stop using the Platform before it takes effect. Continued use of the Platform after a change takes effect constitutes acceptance of the new terms.

9. Dispute Resolution & Governing Law

These Terms of Service are governed by the laws of the Republic of Indonesia, including but not limited to the Consumer Protection Law and the Personal Data Protection Law. Any disputes will first be resolved through deliberation for consensus (musyawarah untuk mufakat). If no agreement is reached within a reasonable time, the parties agree to resolve the matter through the legal channels applicable within the Republic of Indonesia.
